Concise Courses Terms and Conditions
Please read all terms and conditions carefully before applying for one of our courses. Once you have applied for one of our Japanese cultural and language courses and been accepted you agree to be bound by these following terms and conditions.
Please print a copy of these terms and conditions for future reference.
By ordering online you have entered into a binding agreement with us and have agreed to accept these terms and conditions.

2. Service and Course Availability
Concise Courses is intended for use only by students around the world. You do not have to be a British/EU resident to study with Concise Courses. We reserve the right to change the teachers, guest speakers, dates and venues at any time. In addition, we also reserve the right to change the course content without notifying students before or during any course that has been paid for. We will always maintain a high level of service but often due to events beyond our control we might be unable to provide the class with a guest speaker who has previously been contracted to speak at the event.
3. Your Status
By agreeing to study one or more of our language courses, you warrant that:
* a. You are legally capable of entering into binding contracts.
* b. You are at least 18 years old or older.
4. Student and Course Information
4.1 Communicating with the student
The student, (student), once approved to participate in one of our language courses, has to indicate his or her email address, whose operability he has to ensure from the moment he pays for the course. The student has to assure in particular with the adjustment of his or her spam filter (off line and/or by their provider) that he or she gets the emails from Concise Courses.
Concise Courses is authorised, but not obligated, to send messages of any kind – also such messages that are of essential importance for the contractual relationship and the correct implementation of the contract – by other means than electronic mail. In particular the student can neither demand that messages are sent by telephone, letter, and fax or by services of telecommunication systems – e.g. short message services (SMS) – nor can they successfully invoke ignorance if messages by such means of communication are missing, when Concise Courses has sent the message to the email address according to paragraph 1.
Messages of Concise Courses, which are sent by email to the email address according to paragraph 1, are presumed to be received by the student after their dispatch. Concise Courses is only responsible for transmission errors if their causing is based on Concise Courses’s own sphere. The student is allowed to provide evidence that they have not received a message sent to him for reasons that are beyond their sphere.
Concise Courses is regularly not obligated to point out to the student that there is a missing, wrong or an inoperable email address in terms of paragraph 1. However, the student is allowed to provide evidence that such a message would have been technically feasible and reasonable.
4.2 Course Cancellation and Deferment
Course fees are payable in full before the commencement of the course.
Course fees are non-refundable in all circumstances except at the discretion of management. The course can be deferred for free to another start date as long as we are notified two weeks, (fourteen week days) before the start of the course. If the course is deferred one week, (seven days) before the start of the course a charge of £50 will be levied from the student to ensure their transfer to a later start date. No refunds will be given if the course is cancelled within seven days before or earlier than the course is due to begin.
4.3 Online Privacy Policy
Your right to privacy is very important to us and we recognise that when you choose to provide us with information about yourself, you trust us to act in a responsible manner. We believe this information should only be used to help us provide you with better service. That's why we have put a policy in place to protect your personal information. We will not provide any of your personal information obtained via the web to other companies or individuals unless required to by law.
Whenever you provide sensitive information (for example, a credit card number to make a payment), we will ensure all reasonable steps to protect it, such as encrypting your card number. We will also take security measures to protect your personal information in storage. Credit card numbers are used only for payment processing and are not retained for marketing purposes.
Our website provides links to third party sites. Since we do not control those websites, we encourage you to review the privacy policies of these third party sites.
Information collected by Concise Courses Limited will be stored and processed in databases owned solely by Concise Courses Limited.
5. IP Addresses and Cookies
We may collect information about your computer, including where available your IP address, operating system and browser type, for system administration and to report aggregate information to our advertisers and improve the layout of the site. This is statistical data about our users' browsing actions and patterns, and does not identify any individual.
For the same reason, like almost all e-commerce websites, we may obtain information about your general internet usage by using a cookie file which is stored on the hard drive of your computer. Cookies contain information that is transferred to your computer's hard drive. They help us to improve our site and to deliver a better and more personalised service. They enable us:
* To estimate our audience size and usage pattern.
* To store information about your preferences, and so allow us to customise our site according to your individual interests.
* To speed up your searches.
* To recognise you when you return to our site.
You may refuse to accept cookies by activating the setting on your browser which allows you to refuse the setting of cookies. However, if you select this setting you may be unable to access certain parts of our site. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you log on to our site.
6. The Contract between Concise Courses and the student(s)
6.1 Your acceptance and agreement to study one or more of our courses constitutes an offer to us to pay for a language course(s). All course applications are subject to acceptance by us and we will confirm acceptance by sending you an email confirming your course(s) details. A legally binding contract between us will be formed only when we send you these course(s) details.
7. Availability and Delivery
7.1 All the specified delivery schedules of course material, (if applicable to the course) will not be fixed. A fixed schedule must have been expressly designated as such and agreed by Concise Courses. As a rule, specified delivery schedules denote planned shipment times.
7.2 The delivery date, (of course material if it is included in the course) is dependant upon receipt and confirmation by Concise Courses of all data, payments and email notices. Deliveries of course material is specified in working days - Mondays to Fridays, excluding public holidays.
8. Risk and Title
8.1 Course material(s) will be at your risk from the time of delivery. If the goods are ready for dispatch and shipment or acceptance of them is delayed for reasons for which we are not to blame, the risk shall pass to the student when the student receives notice that the goods are ready for shipment.
8.2 Ownership of course material will pass to you only when Concise Courses receives full payment of all sums due, including delivery charges.
9. Price and Payment
9.1 The prices of all courses will be as quoted mainly on the enrolment page of Concise Courses’s website.
9.2 These prices include VAT where applicable and delivery costs of student material.
9.3 In addition to VAT Concise Courses are entitled to charge a fee for processing payments. This fee will depend on the payment method used and will be clearly shown on the website before your order is finalised.
9.4 Concise Courses’s website contains information on language course(s) and it is always possible that, despite our best efforts, some courses may on occasion be incorrectly priced. We will normally verify prices according to our qualify control but where a course is less than the stated price, we will charge the lower amount. If a course’s correct price is higher than the price stated on our website, we will normally, at our discretion, either contact you for instructions.
9.5 Concise Courses is under no obligation to provide the course to you at the incorrect (lower) price, even after it has sent you confirmation of course acceptance, if the pricing error is obvious and unmistakable and could have reasonably been recognized by you as a ‘mis-pricing’.
9.6 Payment for all courses must be by via credit card (MasterCard and Visa), debit card (Switch, Solo, Visa, Visa Electron and Maestro), PayPal, by payment in advance. We can also accept cheques and are able to invoice regisetered companies if one of or more of their employees have been sponsored to study with Concise Courses Limited. All students sponsored by their employers in the UK must ensure that the employer's authorisation section of the application form is completed with a purchase order and signed by the sponsor.
9.7 The stated prices apply on the condition that the order data on which the prices are based does not change after conclusion of the Contract. Costs caused by subsequent changes instigated by the student will be charged separately.
9.8 Concise Courses will send invoices solely by post or email. By submitting an application form by paper or online the student agrees to this form of invoicing. Payments will be due regardless of whether and when an invoice is issued.
9.9 Unless specified otherwise, the gross total price will be due for payment before course commencement. Course material and access to the integrated module study tools will not be made available until after full payment has been made.
10. Compliants
10.1 All complaints regarding any aspect of business conducted by Concise Courses can be made at any time.
10.2 The process for complaints require that the student contact our Registered Office in London, (see Section 1) either by email, letter, fax or printed letter.
11. Our Liability
11.1 Concise Courses warrant that any course organised by us is of satisfactory quality. Again, as stated in section 2, we reserve the right to ammend the course without prior notification prior or during the course. We will do our upmost to follow the course as advertised and sold but often events beyond our control make this dificult to execute.
11.2 Our liability for any course purchased through our site is strictly limited to the purchase price of that course.
11.3 This does not include or limit in any way our liability:
# a. For death or personal injury caused by Concise Courses’s negligence
# b. Under section 2 (3) of the Consumer Protection Act 1987
# c. For fraud or fraudulent misrepresentation
# d. For any matter for which it would be illegal for Concise Courses to exclude, or attempt to exclude, its liability.
11.4 If the supplied course materials are incomplete, Concise Courses – at its discretion – will supply a replacement or remedy the materials, to the exclusion of further warranty claims by the student.
11.5 In the event of rescission of the Contract, Concise Courses will refund any money received from you within a reasonable time, generally within eight weeks.
12. Written Communications
Applicable laws require that some of the information or communications Concise Courses sends to you should be in writing. When using its website, you accept that communication with Concise Courses will be mainly electronic - we will contact you by email. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that Concise Courses provides to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.
13. Notices
All notices by you to Concise Courses must be given to Concise Courses by post or email to info at concise-courses.co.uk. We may give notice to you at either the email or postal address you provide when applying for your course. Notice will be deemed received and properly served 24 hours after an email is sent, or three days after the date of posting of any letter. In proving the service of any notice, it will be sufficient to prove, in the case of a letter, that it was properly addressed, stamped and placed in the post and, in the case of an email, that it was sent to the specified email address.
14. Transfer of Rights and Obligations
14.1 The Contract between you and Concise Courses is binding on both parties and on their respective successors and assignees.
14.2 You may not transfer, assign, charge or otherwise dispose of a Contract, or any of your rights or obligations arising under it, without our prior written consent.
14.3 Concise Courses may transfer, assign, charge, sub-contract or otherwise dispose of a Contract, or any of its rights or obligations arising under it, at any time during the term of the Contract.
15. Events outside our control
15.1 Concise Courses will not be liable or responsible for any failure to perform, or delay in performance of, any of its obligations under a Contract that is caused by events outside its reasonable control (Force Majeure Event).
15.2 A Force Majeure Event includes any act, event, non-happening, omission or accident beyond its reasonable control and includes in particular (without limitation) the following:
a. Strikes, lock-outs or other industrial action.
b. Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not), or threat or preparation for war.
c. Fire, explosion, storm, flood, earthquake, subsidence, epidemic, pandemic or other natural disaster.
d. Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.
e. Impossibility of the use of public or private telecommunications networks.
f. The acts, decrees, legislation, regulations or restrictions of any government.
15.3 Concise Courses’s performance under any Contract is deemed to be suspended for the period that the Force Majeure Event continues, and it will have an extension of time for performance for the duration of that period. Concise Courses will use its reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which its obligations under the Contract may be performed despite the Force Majeure Event.
16. WAIVER
16.1 If Concise Courses, at any time during the term of a Contract, to insist upon strict performance of any of the student's obligations, or any of these terms and conditions, or if it fails to exercise any of the rights or remedies to which it is entitled, this will not constitute a waiver of such rights or remedies and will not relieve the student from compliance with such obligations.
16.2 A waiver by Concise Courses of any default will not constitute a waiver of any subsequent default.
16.3 No waiver by Concise Courses of any of these terms and conditions will be effective unless it is expressly stated to be a waiver and is communicated to the student in writing in accordance with the above.
17. Severability
If any of these terms and conditions, or any provisions of a Contract, are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, they will to that extent be severed from the remaining terms, conditions and provisions, which will continue to be valid to the fullest extent permitted by law.
18. Entire Agreement
18.1 These terms and conditions and any document expressly referred to in them represent the entire agreement between Concise Courses and the student in relation to the subject matter of any Contract and supersede any prior agreement, understanding or arrangement between Concise Courses and the student, whether oral or in writing.
18.2 Concise Courses and the student both acknowledge that, in entering into a Contract, neither party has relied on any representation, undertaking or promise given by the other or be implied from anything said or written in negotiations between Concise Courses prior to such Contract except as expressly stated in these terms and conditions.
18.3 Neither of the parties will have any remedy in respect of any untrue statement made by the other, whether orally or in writing, prior to the date of any Contract (unless such untrue statement was made fraudulently), and the other party’s only remedy will be for breach of contract as provided in these terms and conditions.
19. Our right ot vary these terms and conditions
19.1 Concise Courses has the right to revise and amend these terms and conditions from time to time.
19.2 You will be subject to the policies and terms and conditions in force at the time that you pay for your language course from us, unless any change to these policies or terms and conditions is required to be made by law or governmental authority (in which case it will apply to orders previously placed by you), or if we notify you of the change to these policies or these terms and conditions before we send you confirmation on acceptance on the course (in which case we have the right to assume that you have accepted the change to the terms and conditions, unless you notify us to the contrary within seven working days of receipt by you of your intention to cancel the course).
20. Law and Jurisdiction
Contracts for the purchase of Products through our site will be governed by English law. Any dispute arising from, or related to, such Contracts will be subject to the non-exclusive jurisdiction of the English courts.
